In its summary report, the Senate Committee of Inquiry criticised the content of the agreement reached between the government and EDF on regulating the price of nuclear electricity post ARENH. The Commission considers that the proposed scheme does not really regulate the price of nuclear electricity and that it puts both EDF and consumers at risk. The price of €70/MWh on which the agreement is based is not binding on EDF, which is in fact authorised to sell its production at market price unless prices rise significantly. The Senate Committee is proposing the introduction of a contract for difference for the existing nuclear fleet, with a price of €60 to €65/MWh. Under such a scheme, the price of nuclear electricity would be fully regulated.
