The French Energy Regulatory Commission (CRE) and the French Competition Authority (ADLC) have alerted the government to the pitfalls of the regulatory scheme that is due to replace Arenh in 2026. The CRE and ADLC believe that it will be difficult to guarantee fair competition between EDF and its competitors under the new system. They suggest a number of measures to ensure a level playing field: requiring EDF to identify precisely and on the basis of verifiable information the commercial flows in volume and value between the group's various entities (EDF Producer, DOAAT and EDF Commerce); preventing EDF Commerce from having access to non-public information on the availability of nuclear power; and "explicitly" requiring EDF Commerce to obtain supplies under the same conditions as its competitors.
